These Terms of Service ("Terms") govern your use of the Dragonfly Farm & Nursery website at dragonflyfarmandnursery.com, our related online storefront, and the products and services we offer (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About us

Dragonfly Farm & Nursery is an independent plant nursery located at 49295 Hwy 101, Langlois, Oregon 97450. You can reach us at 541-844-5559 or through the Contact page on the Site.

2. Eligibility

You must be at least 18 years old to place an order on the Site. By placing an order, you represent that you are of legal age to form a binding contract in your jurisdiction and that the information you provide to us is accurate, current, and complete.

3. Your account

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. Please notify us promptly of any unauthorized use.

4. Products, availability, and pricing

We sell live plants, seeds, gift cards, and related items. Plant availability changes constantly with the seasons and our growing conditions. A product shown on the Site is not a guarantee that it is currently in stock. We reserve the right, at our sole discretion, to:

  • limit quantities of any product;
  • refuse or cancel any order;
  • correct pricing or product information errors, including after an order is placed;
  • substitute a similar cultivar or size when the exact item ordered is not available, after first contacting you.

Colors, sizes, and forms of live plants vary naturally. Photos on the Site are representative and not guarantees of the exact plant you will receive.

5. Orders, payment, and plant holds

When you place an order, you are making an offer to purchase. We accept your offer only when we charge your payment method and confirm the order. Orders are typically fulfilled from our nursery in Langlois, Oregon. We may also hold plants for customer pickup. Our Hold Policy governs the terms of holding plants for customer pickup, including hold duration and forfeiture.

6. Shipping, pickup, and local delivery

Most orders are picked up at the nursery. Where we offer shipping or local delivery, charges and timelines are shown at checkout and may vary by region and season. Live plants ship when weather and plant dormancy allow, which may delay orders placed in extreme weather periods. We will contact you if we need to hold a shipment for plant health reasons.

7. Plant care and survival after purchase

Live plants require appropriate care to thrive. Once a plant leaves our nursery, its survival depends on the conditions you provide: site, soil, water, climate, pests, and establishment care. We do our best to send plants in healthy condition and to give honest, regionally-grounded growing information. However, we cannot guarantee that any plant will survive after it leaves our care. Your remedies for plants that arrive in unsatisfactory condition are described in our Refund Policy.

8. User conduct

When using the Site, you agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • upload or transmit viruses, malware, or any other harmful code;
  • attempt to interfere with the Site's operation or security;
  • scrape, harvest, or reproduce content from the Site for commercial use without our written permission.

9. Intellectual property

All content on the Site, including text, photographs, graphics, logos, and product descriptions, is owned by Dragonfly Farm & Nursery or our licensors and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission, except for personal, non-commercial use while browsing.

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site. Linking does not imply endorsement.

11. Disclaimers

To the fullest extent permitted by law, the Site and all products are provided on an "as is" and "as available" basis. Dragonfly Farm & Nursery makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except as specifically set out in our Refund Policy. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of liability

To the fullest extent permitted by law, Dragonfly Farm & Nursery, its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any products purchased through the Site. Our total liability for any claim arising under these Terms will not exceed the amount you paid us in the six months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Dragonfly Farm & Nursery from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

15. Governing law and venue

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law provisions. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Coos County, Oregon, and you consent to the personal jurisdiction of those courts.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
